Conditions of participation

1. Conditions of participation for the JUVIA "Win your Wish list" competition.

1.1 The organizer of the "Win your Wish list" competition (hereinafter: the competition) is JUVIA GMBH & CO. KG, KAP am Südkai, Agrippinawerft 28, 50678 Cologne, Germany, (hereinafter referred to as "JUVIA"). Participation shall be governed exclusively by these Terms and Conditions of Participation, which the participant (w/m/d) accepts without reservation by participating.

1.2 Subject of the competition, publication of the winner (m/f/d)

1.2.1 A 1,000 € JUVIA Online Shop voucher will be raffled among all participants. This is time-bound and can be redeemed at www.juvia.com. The availability of the products on the Wishlist is not guaranteed.

1.2.2 Publication of the winner (f/m/d): In case of winning, the winner irrevocably agrees to the publication of his/her name in the media used by JUVIA, namely website and newsletter. This includes the announcement of the winner on the social media platforms used by JUVIA (namely Facebook, Instagram, Pinterest), as well as reporting on the delivery of the non-cash prizes.

2. Procedure of the competition and conditions of participation.

2.1 Residence in the Federal Republic of Germany, Austria or Switzerland.

2.2 Participation in the competition takes place by sending the completed competition form, creating a customer account, placing an order during the time of the competition and filling the wish list on www.juvia.com with products worth up to 1,000 € including VAT.

2.3 By sending the competition form, the participant accepts these conditions of participation, in particular the publication as a winner, as described in 1.2.2. The closing date for entries is 31.12.2024. The electronically logged receipt of the entry form as well as the electronically logged order confirmation shall serve to verify timely receipt.

2.4 Only one transmitted registration per participant shall be eligible for the prize draw. It is prohibited to use multiple e-mail addresses to increase the chances of winning.

2.5 The winner will be determined after the closing date by means of a random draw among all participants.

2.6 The winner of the draw will be notified by JUVIA by e-mail within 2 weeks after the closing date. In case of undeliverable notification JUVIA is not obliged to make further inquiries and may determine a new winner. If the winner does not respond within one week after the notification of the prize, JUVIA is also entitled to determine a new winner.

2.7 The prize will be handed over exclusively to the winner. An exchange, a self-collection as well as a cash payment of the prize are not possible. Prizes in kind will be sent to the winner by mail to his/her home address, JUVIA will bear the shipping costs. The winner is responsible for any taxation of the prize.

2.8 Participation requires consent to the storage of personal data for the purpose of conducting the competition

3. Termination/cancellation

JUVIA has the right to change or terminate the period of the competition at any time and without prior notice, especially if events of force majeure make it impossible to carry out.

4. Liability

JUVIA shall not be liable for any direct, indirect, special losses and/or damages of the participants in the Sweepstakes arising from participation or related to circumstances of force majeure. JUVIA is not obliged to reimburse any losses of the participants.

Furthermore, JUVIA shall only be liable for the slightly negligent breach of obligations, the fulfillment of which makes the implementation of the contest possible in the first place and on the compliance with which the participant may regularly rely (cardinal obligations), and this shall be limited to the foreseeable damage typical for the contract. The above limitation of liability shall apply mutatis mutandis to the personal liability of JUVIA's legal representatives and vicarious agents.

5. Data protection

For participation, the provision of personal data is necessary. The participant assures that the personal information provided by him, in particular first name, last name, and e-mail address are true and correct. The collection and processing of personal data is solely for the purpose of carrying out the competition. The participant may at any time obtain information about his data stored by JUVIA, object to the use of his data for the future, and request its deletion. For this purpose, it is sufficient to send a simple letter to JUVIA GMBH & CO. KG, KAP am Südkai, Agrippinawerft 28, 50678 Cologne, Germany. After revocation of the consent, the collected and stored personal data of the participant will be deleted immediately. Further regulations regarding the handling of personal data can be found in JUVIA's privacy policy.

In addition to the right to revoke consent granted to JUVIA, the participant has the following rights if the respective legal requirement is met:

the right to information about your personal data stored by us in accordance with Art. 15 GDPR;

the right to correct incorrect data or to complete correct data in accordance with Art. 16 GDPR;

the right to delete your data stored by us in accordance with Art. 17 GDPR, provided that no statutory or contractual retention periods or other statutory obligations or rights for further storage are to be complied with;

the right to restrict the processing of your data in accordance with Art. 18 GDPR, insofar as the accuracy of the data is disputed by you, the processing is unlawful but you refuse to delete it; the controller no longer needs the data, but you need it to assert, exercise or defend legal claims or you have objected to processing in accordance with Art. 21 GDPR;

the right to data portability in accordance with Art. 20 GDPR, i.e. the right to receive selected stored data that you have provided to us in a commonly used, machine-readable format, or to request its transfer to another controller

the right to lodge a complaint with a supervisory authority, such as the supervisory authority of your usual place of residence or the registered office of Schöffel.

Please note that in the event of blocking or deletion of the data, it may no longer be possible to participate in the action.
Right of objection

Under the conditions of Article 21 (1) DSGVO, data processing may be objected to for reasons arising from the situation of the data subject.

This general right to object applies to all processing purposes described in this Privacy Policy, which are processed on the basis of Article 6(1)(f) DSGVO. Unlike the specific right to object-directed data processing for promotional purposes, under the GDPR we are only obliged to implement such a general right to object if you provide us with reasons of overriding importance for doing so (e.g. a possible risk to life or health).

6. Miscellaneous

German law shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Mandatory provisions of the state in which the participant has his place of residence (i.e. either Germany, Austria, or Switzerland) shall remain unaffected.

Should individual provisions of these Terms and Conditions of Participation be invalid or contradict the statutory provisions, this shall not affect the remaining provisions. In this case, the statutory provisions shall apply. The same applies to the closing of a contractual loophole.
